Terms and Conditions

These Terms and Conditions govern the provision of photography services by Nuno G. D. Artur (tax no. 216784514), 4400-239 Vila Nova de Gaia, Portugal (the "Photographer"), reachable at nunoarturphoto@gmail.com.

They apply to requests and bookings made through this website or by email/message, by consumers.

The Photographer provides photography services (sessions and events) and the corresponding editing and delivery. The packages and their contents are described on the Services page of the website.

Prices are provided on request, through a personalised quote tailored to each request. The approved quote, including the service, date and price, forms part of the contract between the parties.

Unless otherwise agreed in the quote, payment is made in three stages:

• 25% on entering the contract/booking, to secure the date — this amount (deposit) is non-refundable;
• 50% on a date prior to the scheduled date — refundable if the cancellation is communicated at least one month before the scheduled date;
• the remaining amount before delivery of the work.

The payment method is indicated in the quote.

Unless a specific agreement is set out in the quote, the final work is delivered within 2 weeks after the session/event.

Unless specifically agreed otherwise, photographs are delivered as high-resolution JPEG files, via an online gallery.

The online gallery remains available for download for 2 years from delivery.

The Photographer keeps a backup of the work for 5 years; within this period, and subject to availability, access to the gallery can be restored or the files re-sent.

Digital content is covered by the legal conformity guarantee (Decree-Law no. 84/2021): the client must report any lack of conformity and the Photographer will restore conformity as legally required.

Cancellation by the client:

• The 25% deposit secures the booking of the date and is non-refundable.
• The 50% instalment is refundable if the cancellation is communicated at least one month before the scheduled date; if communicated less than one month before, this instalment is not refunded.

Rescheduling: possible subject to availability and reasonable advance notice (ideally at least one month); amounts already paid are applied to the new date. Specific conditions may be adjusted in each job's quote/contract.

For distance contracts, consumers generally have 14 days to withdraw from the contract without giving a reason (Art. 10 of Decree-Law no. 24/2014).

However, under Art. 17 of the same law, this right does not apply to the provision of leisure services where the contract provides for a specific date or period of performance. This is the case for sessions and events scheduled for a set date, to which the right of withdrawal does not apply.

Where applicable, the consumer may exercise this right by communicating their decision unequivocally by email to nunoarturphoto@gmail.com, and may use the model form below. If the service has already been fully performed with your prior agreement, the right of withdrawal ceases.

The service is provided with the quality and conformity legally required. In the event of non-conformity, the consumer has the rights provided by applicable law.

These Terms are governed by Portuguese law. In the event of a consumer dispute, the competent Alternative Dispute Resolution entity indicated on the Legal Notice page applies.
